The rule is effective on June 1, 2005. The rule implements requirements contained in the Fair and Accurate Credit Transactions Act of 2003 (FACT Act) which requires that persons who possess or maintain, for a business purpose, consumer information derived from consumer reports, properly dispose of the information. The purpose is to take reasonable measures to protect against unauthorized access to, or use of, the information when it is disposed of.
