Non-owned Automobiles RENTAL VEHICLES & OTHER FORMS OF RENTED TRANSPORTATION INSURANCE PROGRAMS Effective July 1st, 2005 there are a number of significant changes to the Rental Vehicle Coverage. The changes have been hi-lighted in red for quick reference. Please be sure to read these changes and if you have any questions please contact 220-5719 or 220-5847. PLEASE NOTE: This is a short summaryof the above insurance program that has been prepared for quick reference. It does not include all of the conditions and exclusions that might applyon this policy. SECTION1: Automobile Rental Insurance SECTION 2: Guidelinesfor Renting Vehicles on University Business SECTION3: Rental of Other Means of Transportation SECTION4: Reporting an Accident& Making a Claim ALERT.......DRIVING 15 PASSENGER VANS IN BRITISH COLUMBIA SECTION 1: AUTOMOBILE RENTALS There are two types of insurance programs listed under this section. One program is for those automobiles that are rented within Canada andthe U.S., and the other program is for those automobiles that are rentedthroughout the rest of the world. What is Covered This University non-owned auto program covers automobiles that are rented from RentalAgencies that are being used for University business. Please note: Insurance coverage for +30 day rentals is included in the Non-Owned Automobile insurance as of June 13, 2005 (previously they were added in the Owned Automobile Insurance) and these rentals are no longer required to be reported. WITHIN CANADA AND THE U.S. the University of Calgary insuranceprogram includes : liability insurance which covers damage to the property of othersand injuries to individuals. ADVICE : This program provides excess insurance over and abovethat which the Rental Agencies carry. The liability coverage providedby the Rental Agency and the University's excess policy should providesufficient coverage while you are engaged in University business. PLEASE NOTE : if you are not engaged in University businessat the time of the accident, you will NOT be covered by the Universityof Calgary liability insurance policy. You may, however, be coveredunder the Rental Agencies liability insurance as Canadian law requiresRental Agencies to carry $1 million in third party liability coverage. Rental Agencies in the United States may carry less or none at all, dependingon the States in which they are located. Please check with the RentalAgency at the time of rental for this information. collision and theft of Rented Automobile insurance up to a valueof $60,000 . University insurance does not include RentedAutomobiles that are used for recreational purposes. Under this policy there is currently a $1,000deductible, which will be the responsiblity of the department or trustholder. ADVICE : For Rented Automobiles that will be used for recreationalpurposes, for non-University business or for Rented Automobiles valuedat more than $60,000 , purchase the Collision Damage Waiver or Loss DamageWaiver for the full term of the rental from the rental company at the timeof the rental. If your department or trust holder does not wish to be responsible for the $1,000 deductible per accident through the current University insurance policy,we would also recommend that you purchase the Collision Damage Waiver from theRental Agency which will have a lower deductible. NOTE 1: Rental Agencies do not cover collision damage to the vehicle,unless the renter has purchased a Collision Damage Waiver or Loss DamageWaiver from the rental company at the time of the rental. See #7 for more information on other insurance coverage's. NOTE 2: Any damages not covered under the Collision Damage Waiver or the Loss Damage Waiver, will result in the department or trust holder being responsible for the $1,000 deductable. WITHIN THE REST OF THE WORLD the University of Calgary insuranceprogram includes : liability insurance which covers damage to the property of othersand injuries to individuals. ADVICE : This program provides excess insurance over and abovethat which the Rental Agencies carry. However, Rental Agencies inmany countries may not automatically provide liability insurance for personsrenting their vehicles. Also, the University's policy DOES NOT covercollision or theft of Rental Automobiles. Therefore, purchase themaximum liability, collision, accident and theft insurance that the RentalAgency offers while traveling in countries outside of Canada or the UnitedStates. Who can drive a Rental Automobileunder this Program and for What Purposes? This policy only applies to Rental Automobiles that are being drivenon University business. NOTE: Individuals holding the following types of licenses are not allowed to drive on university business: learners, probationary, Class 6, Class 7 or graduated Class 5. Persons covered under this policy includeQualified Drivers with a valid drivers license (see NOTE 2 below) who areregistered with Insurance & Risk Management and who fall into one of the three followingcategories: University of Calgary staff; University of Calgary volunteers (with written permission from the DepartmentHead or designate); University of Calgary students when the vehicle is being used for courserelated field trips OR varsity team transport. Please note, the tripmust be under the supervision of a University employee and permission mustbe granted by the Department Head or designate NOTE 1: When using Budget Rent a Car in Calgary (the University ofCalgary's vehicle rental agency), drivers must be 21 years of age orolder. Other Automobile Rental agencies may require drivers to be 25 yearsof age or older. It is the Renters responsibility to check with the RentalAgency to ensure that their driver's are in compliance with the Rental Agency'spolicy. NOTE 2: Qualified Drivers must have (A) completed, and the department has approved, the on-line University of CalgaryDriver's Agreement form, see Drivers Agreement Form , and (B) the Authorization for Driver Information form is dated and signed and submitted to Insurance & Risk Management , and (C) be qualified to drive in Alberta. NOTE 3: According to Alberta Registries, International Students attendingon a student visa may drive a vehicle in Alberta with their home countryDriver's License as long as it is in English. Otherwise they must obtaina Canadian Driver's License. Other International Drivers that are on awork visa are required to obtain a Canadian Driver's License after beingin Canada for three months. GOTO Rental Vehicle Agency - Materials Management Web Page NOTE: Drivers involved in a) multiple accidents within a twoyear period b) a serious accident or c) a serious driving infraction while driving on University related business may be reviewedby Insurance & Risk Management. The results of this review may require the driver to attend a Drivers Safety course in order to continueas a Driver insured under this program or could result in suspension of driving privileges. Passengers Hitchhikers must not be picked up or carried at any time. What is Not Covered personal property of the driver or occupants University of Calgary property located inside or carried outside on theRental Automobile or trailer (see PropertyInsurance Program) personal automobiles. Although employees may use their personal automobilewhile on University business, the University's insurance policies do notprovide coverage. Car owners are advised to check in advance withtheir own insurance agent to secure an appropriate endorsement to theirpolicy, if necessary. The additional costs of such endorsements arethe personal expense of the car owner and are deemed to be compensatedfor within the current kilometrage rates. For further informationon this topic, please see the Universityof Calgary Travel Policies & Guidelines vehicles which are carrying hazardous materials or goods Rental Automobiles which are not being used for University business atthe time of an accident or theft, but for recreational or leisure activitiese.g. sightseeing trips outside of the area of business. In this casethe University insurance program will deny coverage. Please ensurethat you have adequate coverage for yourself (either with a credit card,your personal automobile policy, or buying down the Rental Agencies insurance) if the vehicle will be used for purposes other than University business. collision damage above $60,000. Special Conditions of Rental AutomobileInsurance Program The rules listed in the agreement with the Rental Agency must be followed. They should indicate whether or not their vehicles are allowed out of Province,State or Country. If you are planning to change states, provincesor countries, ensure that you inform the Rental Agency. Only the qualified drivers as indicated in #2 above may drive the vehicle. These drivers must be listed on the Rental Agency agreement. University of Calgary Rental Automobile Insurance Program coverage maybe void in the following conditions: if the driver is found legally impaired; if alcohol or illegal drugs are found in the vehicle; if the vehicle is used for any illicit or prohibited trade or transportation; PLEASE NOTE : the individual signing out a vehicle and/or thedriver may be held legally responsible for charges and/or litigation resultingfrom vehicle misuse (which includes, but is not limited to, any of theSpecial Conditions listed herein). ADVICE: In order to ensure that the Rental Automobile is coveredunder this Insurance Program, write the renter's name and also the Universityof Calgary's name on the Rental Agency agreement. Deductibles Under this policy there is currently a $1,000 deductible, which will be the responsiblity of the department or trustholder, if it is determined that the driver of the rentalvehicle was at fault. Where it is determined that the accident isthe fault of the other driver, the department will not be charged. WITHIN CANADA AND THE U.S.: $1,000 deductible for all losses (including glass) where the collision and/or upset loss is under the deductibles listed above, G.S.T. will be charged on all repair costs; WITHIN THE REST OF THE WORLD: $1,000 deductible for all losses (including glass) where the collision and/or upset loss is under the deductibles listed above, G.S.T. will be charged on all repair costs; Additional personal coverage thatmay assist in the case of a loss (not purchased by the University) University American Express Corporate Travel Card - additional theft andcollision damage insurance can be obtained at no additional cost if anemployee rents a passenger vehicle using their University American ExpressCorporate Travel Card and denies the rental company's damage waiver atthe time of rental. The American Express Travel card will provideinsurance for automobiles, Sport Utility or 8 passenger or less mini vanswith a gross vehicle weight of 2665 kilograms (5875 pounds). Excludedfrom the American Express Corporate Card coverage are exotic, antique orexpensive (more than $65,000 Canadian) cars; all trucks or vans (otherthan mini); off road vehicles (ones designed primarily to be driven offpublic roads); motorcycles; mopeds; recreational vehicles; campers; andtrailers. The insurance provided by the American Express Corporatecard will provide coverage during the rental period regardless of whetherthe vehicle is being used for business or recreation. For completeinformation or questions on insurance coverage provided by the AmericanExpress Corporate Travel Card call 1-800-243-0198. PLEASE NOTE: if you are relying on a credit card for insurancecoverage, the credit card insurance coverage will likely only apply tothe one vehicle that is being driven by the person whose name is on thecard. It will not cover any other vehicles, even if they are rentedwith the same card. Personal Automobile Insurance Policy - your Personal Policy may have anextension to include automobiles that you rent. Please check yourpersonal insurance policy for this information. Other credit cards may have additional coverage for rental vehicles whenthe card is used to rent a passenger vehicle. Please check with yourcredit card company for this information. SECTION 2 - GUIDELINESFOR RENTING VEHICLES ON UNIVERSITY BUSINESS Rent the vehicle in the University's name (i.e. John Doe, University ofCalgary). Name any additional drivers on the agreement and watchfor the age limits that apply. Rent from a well known company, both while in and out of North America. If you are renting a vehicle for departure from Calgary you can arrangethis through the University of Calgary APEX system. If renting for departurefrom outside Calgary, Budget and National Tilden are world wide. For Universityrates outside of Calgary see CAUBO/AUCCCorporate Car Rental Rates Rent only passenger-type or light commercial vehicles (i.e. cars, lighttrucks or passenger vans) as other types of vehicles may not be coveredunder the University's Rental Automobile Program. If you are intending to use the rental vehicle for recreational purposes,do not decline the Collision Damage Waiver, the Loss Damage Waiver or thePersonal Accident Insurance, unless you have verified with your creditcard or automobile insurance company that adequate coverage is availableunder their policies. Ensure that you understand the car rental agreement. It will statethat only authorized drivers may drive the vehicle, where you may not drivethe vehicle (i.e. off road), that the vehicle must be locked at all times,that you cannot drive illegally (i.e. under the influence of alcohol orover the speed limit), etc. It is your responsibility to ensure thatyou understand the terms and conditions under which you are renting thevehicle. While outside of Canada and the United States purchase the maximum liability,collision and accident insurance that the rental company offers. Let the Rental Agency know where you are driving, especially if you areintending to drive out of the country, or the state In the event of an accident, inform the Rental Agency immediately. Notify your credit card company (if applicable) and the University as soonas possible (403-220-5333). Ensure that you retain copies of the policereports, all rental company documentation and bills or invoices. Ensure that you store your personal property out of sight in the car. Do not leave valuables where they can be seen. It is also safer toensure that anything that identifies you as a "tourist" (i.e. maps, binoculars,etc.) is out of sight when you leave the car SECTION 3 - RENTALOF OTHER MEANS OF TRANSPORTATION Any other form of transportation either than an automobile or van (i.e.aircraft, watercraft, etc.) may not be covered by the University's InsurancePrograms. Please ensure that you contact the Insurance & Risk Management department (220-5719) prior to undertaking these type of rentalsto see what coverage is available through the university. SECTION 4 - REPORTING AN ACCIDENT AND MAKING A CLAIM To report an accident (seeReporting A Motor Vehicle Accident - Automobile Rented on University Business) To make a claim: When Insurance & Risk Management receives the report of the accidentfrom Campus Security, they will open a claim file. The vehicle driverwill be required to provide the following information: further particulars about the accident, if required a copy of the Rental Agency contract a copy of any bills received from the Rental Agency for the accident a copy of the accident report filled out for the Rental Agency. RV buyers have many choices when it comes to paying for their purchase, but they always make the right one? Here are some tips on how you can determine if you are making the wisest choice by paying cash for your RV.... and why you may want to consider financing your RV instead. Tax deductibility of interest on RV / Motorhome loans Under IRC section 163 (h)(2) a taxpayer may deduct any qualified interest on a qualified residence, which is defined as a principal residence and one other residence owned by the taxpayer for the purpose of deductibility for the tax year. IRC section 163(h)(3) defines qualified residence interest as any interest which is paid or accrued during the tax year on acquisition or home equity indebtedness with respect to any qualified residence of the taxpayer. In accordance with IRC section 163(h)(4), an RV will be considered a qualified residence if it is one of the two residences chosen by the taxpayer for purposes of deductibility in the tax year as long as it provides basic living accommodations such as sleeping space, a toilet, and cooking facilities. If the RV is chartered out, the taxpayer will have to use the RV for personal purposes for either more than 14 days or 10% of the number of days during the year the RV was actually rented, in accordance with IRC section 280A(d)(1). Form 1098 is not necessary in order to receive the qualified interest deduction. In accordance with IRS instructions for Schedule A, form 1040, if the taxpayer does not receive form 1098, deductible mortgage interest should be reported in line 11 instead of line 10 on Schedule A. Borrowing against your unencumbered home has limitations Home mortgage interest deduction is limited to interest paid on mortgage debt used to purchase or improve a residence, or to refinance the remaining balance on a purchase or improvement. If the money isn't used for the home, the interest expense does not qualify for the deduction. So does a home equity loan Home mortgage interest deduction is limited to interest paid on home equity loans up to $100,000. By using a home equity loan, you may limit the amount of interest that is deductible, if your RV loan balance exceeds $100,000. Borrowing against your stock portfolio isn't the best answer, either Second home mortgage interest deduction is limited to interest paid on second homes that are secured by that second home. You would need to have a written collateral agreement (security agreement) indicating the RV as collateral, which is probably not something your broker would be prepared to provide. In the example below it's easy to see that investment earnings can far exceed the cost of RV / Motorhome financing. In this particular case we are assuming a rate of 8.5% fixed for 20 years on a loan of $100,000, requiring a monthly principal and interest payment of $867.82. The interest cost of this loan over an anticipated life of 60 months is $40,196.30. If you are in the 30% tax bracket, this interest expense deduction will save you $12,058.91, effectively reducing the cost of the loan to $28,137.39. This same $100,000, if invested earning 9%, would grow to $137,703.68 (after tax) in the same time period. Tax-free municipal bonds yielding 6% could earn $34,885.02 over 60 months. More aggressive investments could obviously make earnings even more attractive. It's easy to see how financing your RV / Motorhome could cost you less. Note : The above example was developed to help explain the advantages of RV Financing and is not a guarantee of what is available in the market at any particular time.
